The Alabama Supreme Court yesterday granted a temporary stay in Mr. Myers’ case. This stay puts a hold on Myers’ current execution date of June 18, 2015.
The stay is due to litigation pending in the Middle District of Alabama regarding Alabama’s lethal injection protocols and whether the use of the drug midazolam violates the Eighth Amendment to the U.S. Constitution.
This litigation is similar to a case currently pending before the U.S. Supreme Court, Glossip v. Gross out of the 10th Circuit that is set for oral argument before the Supreme Court on April 29, 2015.
The Supreme Court is likely to decide Glossip by June 2015.
While this stay is great news, it does not end the fight for clemency in Mr. Myers’ case. It does, however, give us more time to galvanize resources and bring more people to Mr. Myers’ side in that fight.
