The Arc urges Bentley to commute Robin “Rocky” Myers’ death sentence

The Arc, the premier organization for protecting the rights of the intellectually disabled in the USA, urges Alabama’s governor, Robert J. Bentley, to commute Robin “Rocky” Myers’ death sentence. The letter, penned by Peter Berns, The Arc’s CEO, includes a variety of details about Myer’s specific case:

“I write on behalf of the Arc of the United States to urge you to commute the death sentence of Robin “Rocky” Myers to life without the possibility of parole. Mr. Myers’ personal history appears replete with evidence indicating the presence of intellectual disability (ID) which brings him under the protection of the United States Supreme Court’s decisions in Atkins v. Virginia, 536 U.S. 304 (2002) and Hall v. Florida, 134 S. Ct. 1986 (2014).”

Berns further states that “[t]he evidence of Mr. Myers’ intellectual disability means that Mr. Myers’ death sentence violates current prohibitions against cruel and unusual punishment as set forth in the U.S. Supreme Court decisions in Atkins and Hall. He should be facing life without parole, not a death sentence.”

“As a family-based organization, The Arc has deep sympathy for the family and friends of the victim in this case and we support appropriate punishment of all responsible parties. The Arc does not seek to eliminate punishment of Mr. Myers or others with disabilities, but, rather to ensure that justice is served and the rights of all parties are protected.”

The Arc is a national non-profit organization that began more than 65 years ago from a grassroots movement of families working vigilantly to create services for children and adults with intellectual disabilities. Today, The Arc consists of over 700 chapters nationwide, and is on the front lines ensuring that people with intellectual and developmental disabilities and their families have the support and services they need to be fully engaged in their communities. The Arc works to create a network of human service agencies ensuring those it seeks to protect and support have the strongest civil rights advocates promoting and protecting their needs at all levels.

There is clear evidence that Mr. Myers is intellectually disabled within current expert reports, within historical school records, and within interviews and affidavits of those who have known Mr. Myers his entire life.
